Suing eBay Inc. after an Electric Scooter Handle Bar Collapses or Causes Injury

Electric scooters have become a popular alternative to other methods of transportation, but with their rise in popularity also comes a rise in injuries.

Pennsylvania Woman Injured by Defective Electric Scooter Sues eBay Inc.

On or about Dec. 13, 2021, a Pennsylvania woman sustained serious personal injuries and damages when the handlebars of the electric scooter she was operating suddenly collapsed. This caused her to lose her balance, fall, and suffer injuries, including a trimalleolar fracture to her right ankle requiring surgical repair with metal plates and numerous screws.

Specifically, the plaintiff believed the scooter she was operating to be an Iwheels brand D8 Pro model which she purchased from a user named fast-trust on the eBay Inc. online sales platform. Despite the risks and dangers associated with e-scooters that were available to it, eBay Inc. took no action to further the safety of its consumers from dangerous and defective e-scooters. Due to the defendant’s involvement in the sale of the scooter, she seeks civil damages for personal injuries and damages resulting from the sale of the dangerous and defective scooter.

Scooter Injuries Are Common With Defects Causing Many Injuries

Scooter injuries are becoming increasingly common. According to the U.S Consumer Product Safety Commission, there were more than 190,000 emergency room visits due to micro-mobility products from 2017 through 2020, with visits increasing 70 percent during that time period. This includes e-scooters, e-bikes, and hoverboards. Most of the increase between 2017 and later is attributable to e-scooters which have grown in popularity as companies like Bird and Lime introduced rentable e-scooters into cities across the country.

Loose or detaching handlebars, batteries bursting into flames, flat tires and baseboards breaking in half are all commonly reported defects in recent years.  Although we are not investigating flat tires and baseboards, we are investigating potential cases concerning exploding batteries and handlebars that have failed.
