A spat of recalls shows infants are dying while using baby sleepers. A recall this week, shows at least 15 babies died while using Rocking Sleeper. Specifically, the federal government’s Consumer Product Safety Commission (CPSC) announced another recall.

The safety recall concerns “All models of Kids2 Rocking Sleepers” The safety recall concerns early 700,000 units. There was a prior recall in April 2019.

That prior recall was for the same product, All models of Kids II Rocking Sleepers. The baby sleeper safety risks involved “Infant fatalities [that] occurred in the Rocking Sleepers, after the infants rolled from their back to their stomach while unrestrained, or under other circumstances.” This week’s recall is more of the same, just noting more deaths.

15 infants have died from the Kids2/KidsII Rocking Sleepers

Over the last few years, 15 babies have died using this baby sleeper. Specifically, CSPC identified the risk as follows:

“A total of 15 infant fatalities were reported to have occurred in the Kids2 Rocking Sleepers, after the infants rolled from their back to their stomach or side while unrestrained, or under other circumstances. Eleven deaths were reported to have occurred before the recall, (including five deaths previously reported by CPSC and Kids2 at the time of the original recall). Four fatalities were reported to have occurred after the recall was announced. Kids2 notes that in some of the reports, it has been unable to confirm the circumstances of the incidents or that the product was a Rocking Sleeper.“

The 2019 recall noted only five deaths since 2012. So this dangerous product has now claimed three times as many infants in just three years! Next, we identify the specific Kids 2/Kids II products.

The baby sleeper death recall concerns dozens of baby sleepers

The recall applies to ALL models of Kids 2/Kids II Rocking Sleepers. The following is a list of specific products:

With that said, none of them should be used. And, other manufacturers have unsafe baby sleepers as well. Companies offer a refund; however, there are significant damages at issues.

The Recall Provides for a Refund, But Families of Babies Injured by Baby Sleepers Have Legal Rights

The notice instructs that, “[c]onsumers should stop using the rocking sleeper immediately and contact Kids2 for a refund.  It is illegal to sell or distribute the recalled sleepers.”

Nevertheless, these baby sleepers remain on the market. Indeed, more babies have died since the first recall.

Fortunately, they have legal rights. Moreover, they could waive rights to significant compensation by accepting if there are waiver agreements involved.
