Testosterone Lawsuit

Pharmaceutical companies can be conniving, often using psychological and strategic marketing techniques to drive the sales of their products. The companies that manufacture testosterone replacement therapy products are no different. They have aggressively marketed their products as solutions for men suffering from a condition known as “Low-T,” a baseless term that was also manufactured by the pharmaceutical companies.

Low-T is a medically unproven condition that pharmaceutical companies describe as exhibiting symptoms such as low sex drive, loss of muscle tone, and fatigue. Testosterone replacement therapy has been approved to treat men with low testosterone levels caused by hypogonadism, a condition that causes naturally occurring hormone testosterone not to be released within the body in standard amounts, but not for “Low-T.”

Many men have taken testosterone therapy drugs for Low-T were never tested to see if they even needed any kind of testosterone therapy or that they even had below average hormone levels. Some of these men were merely just showing signs of natural sexual decline due to aging.

What are the Main Claims in a Testosterone Therapy Lawsuit?

  • The pharmaceutical companies have failed to make the adverse side effects of their testosterone therapy products widely known among consumers and doctors.
  • The pharmaceutical companies knew the health risks associated with their testosterone drugs but continued to put their testosterone products on the market.
  • The pharmaceutical companies created marketing advertisements that would target older men and make them believe they need their product when in fact, these men did not have a hormone imbalance.

These men, who may have had no adverse medical condition, to begin with, were prescribed these testosterone drugs and after long-term use, severe health complications began to surface. A large number of victims have already taken legal action against the manufacturers of these testosterone drugs, and more claims continue to be filed.

What Is Testosterone?

Testosterone is the naturally occurring sex hormone produced by the male body. This hormone directly affects muscle mass, fat distribution, and fertility in men. Many men, as they age, show a decreased level of testosterone, which can lead to life-altering mental and physical side effects such as depression, fatigue, and low sex drive.

Testosterone therapy and treatments are accepted medical solutions used to treat hypogonadism, the medical term to describe men whose bodies produce little or no testosterone. Doctors recommend testosterone replacement therapy and treatment for men with certain conditions by replacing the diminished testosterone and stabilizing the patient to a natural level of the hormone.

However, the medicine and products associated with the treatment can still cause drastic side effects in some patients, including but not limited to:

  • Venous thromboembolism
  • Deep vein thrombosis
  • Cerebrovascular accident/stroke
  • Myocardial infarction/heart attack
  • Pulmonary embolism
  • Death

Suffering from a low testosterone level, unfortunately, is also used as a marketing ploy by drug companies, preying on feelings of insecurity, shame, and cultural perception. They create ad campaigns frequently depicting men with higher testosterone levels as being “alpha males” and “more successful” than those with lower testosterone levels.

Causes Of Low Testosterone

There are many different reasons that a man may have a low level of testosterone. Primary hypogonadism is one of the basic types and can be caused by underactive or underdeveloped sex organs. The low activity can be caused by injury, illness, or an inherited trait. Some of the worst illnesses that can cause primary hypogonadism are:

  • Undescended Testes
  • Klinefelter’s Syndrome - an extra X chromosome
  • Hemochromatosis - too much iron in the body
  • Cancer treatment
  • Mumps Orchitis - inflammation of the testes related to mumps
  • Physical injury to the testes

Secondary hypogonadism is caused by damage to the hypothalamus or the pituitary gland. These are both parts of the brain that control hormone production through the male sex organs. Diseases that can lead to secondary hypogonadism are:

  • Pituitary disorders
  • Kallmann syndrome - delayed or absence of puberty
  • Inflammatory diseases - such as tuberculosis

Other circumstances that can lead to secondary hypogonadism are natural aging, obesity, medications, or underlying illnesses. Both primary and secondary hypogonadism should be taken seriously, and treatment options should be explored.

Why Are There Lawsuits?

Thousands of men have filed lawsuits against companies that manufacture testosterone related pharmaceuticals, citing a failure to warn them of the potential side effects of their products. These side effects can be fatal, as they can lead to an increased risk of pulmonary embolisms, blood clots, strokes, and prostate cancer, among others. These lawsuits also allege that the manufacturers of the products marked their products for uses that are not approved by the FDA, such as low sex drive and fatigue, or as they call it “Low-T.”

In some cases, the side effects of testosterone therapy and treatment can cause immediate dangers to the health of a patient, leading the FDA to start investigating these prescription treatments. They decided to carry out these investigations after a study had linked testosterone treatment to increased risks for deep vein thrombosis, heart attacks, blood clots, and other health issues that have lead to hospitalization or even death.

After studying 55,000 men who had low testosterone, the FDA’s findings were published in the medical journal PLOS/ONE. The study showed that some men had an increased risk for cardiac problems, and men over the age of 65 had double the chance of cardiac issues during the first three months of their treatment.

Unethical Testosterone Marketing

The primary issue of testosterone therapy and the negative side effects can be related back to the rate at which the testosterone drugs were being prescribed, and the number of patients who actually needed this drug. Studies have found that about 43 percent of patients who were prescribed testosterone prescription had normal hormone levels and did not need replacement testosterone therapy based on their age. There were also a large group of men who did not have any medical tests conducted for their supposed low hormone levels.

As men age, their testosterone levels naturally decline. This can result in decreased muscle tone, lack of energy, and also, a loss of sex drive. The pharmaceutical companies created the baseless condition Low-T, and sadly many men now believe it is a legitimate condition due to their marketing exploits. These drug manufacturers have been accused of targeting these men as victims, preying on them, by using strategic marketing techniques whose goal is to make men feel like they are failing at “being a man” but have often resulted in permanent damage to these men’s health or even death.

  • Eli Lilly and Company (Axiron)
  • Endo Pharmaceuticals and Auxilium (Delatestryl, Fortesta, Testim, and Testopel)
  • Juniper Pharmaceuticals (Striant)

This list of companies and products are those that are currently inactive lawsuits, and some of these products have even been pulled off of the market. It’s essential that if you or someone you know has used any of these products that you see a doctor, but most importantly that you get the legal help you need.

What are Testosterone Lawsuit settlements amounts?

There are many factors to take into consideration when trying to determine settlement amounts. There have been various testosterone therapy replacement manufacturers that entered into mass tort settlements. On December 2017, Eli Lilly & Co. found themselves agreeing to reach settlements for 400 federal lawsuits. These lawsuits were accusing the company of not correctly warning consumers of the dangers associated with taking their testosterone replacement drugs.

Auxillium Pharmaceuticals, GlaxoSmithKline LLC, and Endo Pharmaceuticals Inc. all agreed to resolve 1,300 federal lawsuits regarding testosterone replacement drugs. More recently, in June 2018, Endo Pharmaceuticals said that they were using $200 million towards settling testosterone therapy claims. Out of the 7 different pharmaceutical companies that are defending against numerous testosterone lawsuit claims, four of these companies have offered settlements, and the other 3 companies are continuing to fight off these claims against them.

Some factors that might affect a potential testosterone injury settlement offer include:

  • How severe the medical injury was from the drug/therapy
  • The overall effect of the drug/therapy on the individual in regards to their overall mental and physical health
  • Any lost wages due to injuries from the drug/therapy
  • The mental and emotional suffering in the past and in the future
  • Medical bills from the past or future that is related to testosterone drugs/therapy
  • If the lawsuit is a case of wrongful death, then the losses suffered by the plaintiff’s surviving family will be taken into consideration.
