Companies recall products. The information sometimes gets to consumers via the media. Sometimes people don’t hear about the recalls. It is important to remind people from occasions. As product liability attorneys, we believe sharing information about recalls is important. Here is one from some years ago concerning the Acrimoto FUV motorcycles.
Arcimoto FUV Motorcycles Recall
On December 7, 2020 Arcimoto recalled some of their FUV Motorcycles. The U.S. National Highway and Traffic Safety Administration (NHTSA) believes that people who drive these motor vehicles are at risk of crashing. The motorcycles were manufactured with an electric defect, affecting the driver’s ability to maneuver the vehicle safely.
Potential Dangers with Arcimoto FUV Motorcycles
While driving a motorcycle offers a sense of freedom and excitement, it also comes with some increased risk and danger, such as:
- A lack of protection in the event of a crash, leaving riders more exposed to injuries from collisions or falls.
- Less stability than four-wheeled vehicles, making them more prone to accidents.
- Less visibility to other drivers, issues with speed and depth perception with other drivers, and they can be overlooked in traffic.
- Riding motorcycles requires significant skill and balance; unexperienced riders may struggle with handling and maneuvering.
- Road hazards like potholes, gravel and wet surfaces can lead to loss of control.
- High speeds and the ability to maneuver quickly can lead to dangerous riding behaviors and increased risk of accidents.
The recall highlights some specific potential risks associated with some Arcimoto FUV motorcycles.
What is the Problem with the Arcimoto FUV Motorcycles included in the Recall?
The problem comes from the electronic drivers in high voltage contactors. These contactors are malfunctioning, causing them to overheat. This can cause the battery to turn off while the driver is using the motorcycle. When the driver experiences a loss of drive power, it can result in a crash.
Arcimoto Sued for Misleading the Public
In April 2021, Arcimoto underwent a lawsuit from one of its purchasers. According to the purchaser, Acrimoto violated the Securities Exchange Act of 1934.
In March 2021, it was revealed that Arcimoto had mislead the public. They had exaggerated the number of pre-orders between the years 2018 and 2020, and only delivered 5% of the pre-ordered bikes.
The company also lied to their customers about how safe their product was. In 2020, Arcimoto recalled all of their production with the NHTSA. However, they kept these safety concerns sealed and never told their customers and investors.
